New Special Counsel Makes First Move, Challenging Claim From Trump Team

Newly appointed special counsel Jack Smith on Thanksgiving made his first public move since being tasked with leading the investigation into whether former President Donald Trump violated the Espionage Act and other federal laws with Trump’s handling of certain records, including records with classified markings.
Assertions by Trump’s attorney are “incorrect,” Smith said in a brief, one-page letter to an appeals court.
Smith was responding to Trump’s attorneys raising the case involving materials seized from Rudy Giuliani, the former New York City mayor who has served as Trump’s lawyer.
James Trusty, one of the lawyers, said that the approach backed by the government in the Giuliani case was a reference for the Trump records case….
